1. Services
Evergreen Staffing Solutions provides direct-hire recruitment and staffing services to employers and candidates. All services are subject to these Terms and any additional agreements executed between the Company and its clients.
2. Employer Responsibilities
Employers agree to:

Provide accurate job descriptions, requirements, and compensation details

Comply with all applicable employment, labor, and anti-discrimination laws

Make all hiring decisions independently

Notify Evergreen Staffing Solutions promptly upon hiring any referred candidate
3. Candidate Responsibilities
Candidates agree to:

Provide truthful and complete information regarding qualifications and work history

Maintain professional conduct throughout the recruitment process

Understand that employment decisions are made solely by employers
Evergreen Staffing Solutions does not guarantee employment to any candidate.
4. Fees and Payment Terms
Placement fees are based on the terms outlined in the applicable service agreement or invoice.
Unless otherwise agreed in writing:

Payment terms are Net 14 days from the invoice date

Fees are earned when a candidate accepts an offer of employment

Late payments may be subject to additional charges as permitted by law
5. Placement Guarantee
Evergreen Staffing Solutions offers a 45-day replacement guarantee for direct-hire placements, subject to the following conditions:

The guarantee applies only if the employee voluntarily resigns or is terminated for cause

No refund is provided; the guarantee is limited to a replacement candidate

The original invoice must be paid in full and on time

The guarantee does not apply to layoffs, restructuring, or changes in job duties
6. Background Checks and Verification
Unless expressly stated in writing, Evergreen Staffing Solutions does not conduct background checks, drug testing, or credential verification. Employers are responsible for conducting any required screenings prior to employment.
7. Limitation of Liability
To the fullest extent permitted by law, Evergreen Staffing Solutions shall not be liable for:

Acts or omissions of candidates or employers

Loss of profits, business interruption, or indirect damages

Employment decisions made by clients
Our total liability shall not exceed the amount of fees paid for the applicable placement.
8. Website Use
You agree not to:

Use the website for unlawful purposes

Attempt to gain unauthorized access to systems or data

Copy or misuse website content without permission
All website content is the property of Evergreen Staffing Solutions unless otherwise stated.
9. Confidentiality
Both employers and candidates agree to maintain the confidentiality of proprietary, sensitive, or non-public information obtained through our services.
10. Third-Party Links
Our website may contain links to third-party websites. We are not responsible for their content, policies, or practices.
11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
